Florida’s Pre-Trial Intervention Program (PTI)

With Florida’s PTI, first-time nonviolent offenders receive deferred prosecution for the charges against them. The offenders enter a program under the supervision of the Florida Department of Corrections that includes counseling and community service. Offenders must not commit any additional crimes. They must also pay restitution for the charged offense.

When the person successfully completes the program, the court dismisses the charges, so there is no record of a conviction. If the program is not completed, the case undergoes prosecutorial review, and appropriate legal action is taken. Non-eligible offenses include:

  • Second degree or higher felony
  • Violent crime or crime involving weapons
  • Attempted residential burglary
  • Driving with a suspended or revoked license
  • DUI
  • Fleeing or eluding law enforcement
  • Leaving the scene of an accident
  • Offense against the government
  • Offense requiring restitution of more than $5,000
  • Organized crime
  • Possession of an anti-shoplifting control device
  • Possession of heroin, LSD, methamphetamine or at least a half-gram of cocaine
  • Welfare or unemployment compensation fraud

Gaining acceptance into Florida’s Drug Court Program

Florida established the drug court as a treatment option for defendants charged with purchasing or possessing drugs or nonviolent felonies stemming from a substance abuse problem. The program diverts offenders from criminal court when treatment for addiction could be more beneficial than being sent to jail. The Drug Court Program includes:

  • Counseling
  • Random drug testing
  • Case management
  • Frequent court appearances

Defendants who successfully complete the program are eligible to have the charges against them dismissed, so there is no record of a criminal conviction.
