  • Trafficking in cannabis — A first degree felony. This is when a person knowingly sells, purchases, manufactures, delivers or brings into the state, or is knowingly in possession of more than 25 pounds of cannabis or 300 or more cannabis plants. Depending on the actual weight, the minimum sentence is three, seven or 15 years. Fines range from $25,000 to $200,000.
  • Trafficking in cocaine — A first degree felony. This is when a person knowingly sells, purchases, manufactures, delivers or brings into the state, or is knowingly in possession of between 28 grams and 150 kilograms of cocaine. Minimum sentences based on weight are set at three, seven and 15 years, and life imprisonment for 150 kilograms or more. Fines range from $50,000 to $250,000.
  • Trafficking in illegal drugs — Involves drugs such as heroin, hydrocodone and oxycodone or their derivatives. Sentences vary depending on weight, with mandatory minimums of three, seven, 15 and 25 years. Fines range from $50,000 to $750,000.

Specific statutes also address penalties for crimes involving phencyclidine, methaqualone, amphetamine, flunitrazepam, GHB, GBL, 1,4-Butanediol, phenethylamines and LSD.

Trafficking charges are unlike drug possession charges in that first-time offenders are not eligible for Florida's drug court diversion program. Mandatory sentences are enforced. Federal charges have even stricter mandatory minimum sentences.

How to defend against Florida drug trafficking charges
